The Trump administration has filed a brief with the Supreme Court, which argued the Affordable Care Act should be overturned. In a late night court filing, the Justice Department asked the Supreme Court to “invalidate” the health care law, which they called “unconstitutional.”
The law currently requires everyone to have health insurance or face a tax penalty. It is a system the president has long opposed.
“My administration is protecting your Social Security, your Medicare, and is fighting to give you great health care. We are defending your right to keep the doctor and to keep your plan of choice. Remember when President Obama would say you could keep your doctor, you can keep your plan? Well, he lied.” – Donald Trump, 45th President of the United States
According to Democrats, Obamacare is vital to people with preexisting conditions. However, President Trump has reassured those individuals they will still be protected under a new system.
“We are protecting people with preexisting conditions and we always will,” added the president. “…We are going to give you the best health care you’ve ever seen at a lower price and, again, protecting preexisting conditions.”
The solicitor general has claimed the Affordable Care Act cannot continue to operate in the absence of the law’s individual mandate, which was removed through congressional action in 2017.
Earlier this week, House Democrats unveiled a bill seeking to expand the act. Supreme Court justices are set to hear arguments on this case sometime during the next term.
