Luigi Mangione’s defense team has filed a motion to dismiss his New York state charges following his guilty plea in federal court over the death of UnitedHealthcare CEO Brian Thompson.
On Friday, following a surprise federal court hearing where Mangione pleaded guilty — just weeks before his federal trial was set to begin — his lawyers revealed that they moved to have the state case dismissed.
By admitting guilt and resolving the federal case, his defense team was able to invoke New York’s double jeopardy protections.
Under state law, double jeopardy can be triggered once a defendant enters a guilty plea in a federal prosecution arising from the same underlying conduct.
In the federal case, Mangione pleaded guilty to stalking resulting in death, which carries a maximum punishment of life in prison. In his state case, which the defense is asking to drop, Mangione faces second-degree murder charges carrying a sentence of 25 years to life.
His New York trial is currently scheduled to begin on September 8, 2026.
